Court: In-laws’ daily taunts part of Married Life

A Sessions Court in Mumbai granted Anticipatory Bail to an elderly couple accused of harassing their daughter-in-law & observed that "talking sarcastically & taunting by in-laws is part of the wear & tear of married life".

The woman got married in 2018 to a Dubai-based school friend. The woman alleged that when she was preparing documents for the registration, a few days before the wedding, she realised that her husband was the biological child of the domestic help. The man had been adopted & raised by the elderly couple.

Woman not allowed to touch fridge

The woman claimed that her parents gave her diamond & gold jewellery worth Rs 1.5 crore but she did not get any gifts from her in-laws. The woman said that the accused didn't allow her to touch the refrigerator & gave her stale food. She further claimed that the accused made her sleep in the living room & did not allow her to visit her mother, the news agency reported.

When the woman complained about the same to her husband, he sarcastically asked her to obey his parents. The woman said that when she was returning from Dubai, her husband gave her 15 kg of dry fruits. When the woman returned to her in-laws' house, her mother-in-law weighed the package before accepting it.

The defence argued that the expenses of the wedding had been split equally between both the families. The advocate said that the accused were not aware of the FIR & learned about it when their accounts were frozen.

Special Judge Madhuri A Baraliya observed, "For those allegations, the custody of the applicants who are old aged 80 years & 75 years respectively, is not required with the police." The court directed the accused to submit passports with the police as the woman alleged that they would flee to Dubai.

The Doctrine of Alternative Danger

THE DOCTRINE OF ALTERNATIVE DANGER Although the plaintiff is supposed to be cautious in spite of the defendant’s Negligence, there can also be certain situations when the plaintiff is justified in taking some threat where some unsafe state of affairs has been created by way of the defendant. The plaintiff may appear as puzzled or worried through a hazardous state of affairs created via the defendant and to store his man or woman or property, or now and again to store a third party from such danger, he may take a choice risk. The law, therefore, lets in the plaintiff to come across a choice danger to shop by himself from the chance created via the defendant. If the path adopted by him results in some harm to himself, his motion in opposition to the defendant will now not fail. The judgment of the plaintiff, however, is not rash. The position can be defined by means of the case of Jones v . Boyce . In that case, the plaintiff used to be a passenger in the defendant’s train and instruct
