2019 MOTORVEHICLE AMENDAMENT ACT
WHY WAS THERE AN AMENDAMENT MADE TO THE EXISTING MOTORVEHICLE ACT IN INDIA , MOTORVEHICLE AMENDAMENT ACT 1988 WAS NOT ABLE TO MEET UP THE REQUIREMENTS OF RISING TRAVEL , MOTORISATION MAJOR SHIFTS AND DIMINISHING ROAD SAFETY ASPECTS .
RISING POPULATION AND ITS IMPACT OVER THE MOTORVEHICHLES WAS NOT KEPT IN LINE .
RURAL TRANSPORTATION WAS IN A DIRE NEED OF SIGNIFICANT REFORM
RISING ROAD ACCIDENTS AND RELATED DEATHS ALSO HELD THE EARLIER BILL UNDER QUESTION .
INCREASED CORRUPTION AND RED TAPISM WAS ALSO A MATTER OF CONCERN .
CAB AGGREGATORS WITHOUT COMPREHENSIVE GUIDELINES CREATED A PROBLEM FOR THE EARLIER BILL AND RAISED AN ISSUE TO AMEND THE BILL .
THE KEY ELEMENTS OF THE ACT ARE:
ROAD SAFETY: THE BILL HAS INCREASED THE PENALTIES FOR TRAFFIC OFFENSES AND OFFENSES SUCH AS CHILD DRIVING, DRUNK DRIVING, DRIVING WITHOUT A LICENSE, DANGEROUS DRIVING, SPEEDING, OVERCROWDING ETC. THE PENALTY WILL INCREASE BY 10% EVERY YEAR.
MOTOR VEHICLE ELIGIBILITY: THE BILL AUTHORIZES AUTOMATIC AUTOMATION TESTING TO REDUCE VEHICLE CORRUPTION AND IMPOSES PENALTIES FOR WILLFUL VIOLATIONS OF SAFETY / ENVIRONMENTAL LAWS.
VEHICLE RECALL: VEHICLES WITH DISABILITIES WILL BE FORCIBLY REPATRIATED. THE MANUFACTURER WILL REIMBURSE THE FULL COST OR REIMBURSE THE DAMAGED VEHICLE.
ROAD SAFETY BOARD: A NATIONAL ROAD SAFETY BOARD WILL BE ESTABLISHED TO ADVISE THE CENTRAL GOVERNMENT AND GOVERNMENT ON ALL ASPECTS OF ROAD SAFETY AND TRAFFIC MANAGEMENT.
PROTECTION OF THE GOOD SAMARITAN: THE BILL DEFINES A ‘GOOD SAMARITAN’ AS DEFINED AS A PERSON WHO PROVIDES EMERGENCY MEDICAL OR NON-MEDICAL ASSISTANCE TO VICTIMS OF ROAD ACCIDENTS. GUIDELINES ARE INCLUDED FOR PREVENTION
CHEAP TREATMENT FOR THE GOLDEN HOUR E. A PERIOD OF UP TO ONE HOUR FOLLOWING TRAGIC INJURIES, DURING WHICH THE CHANCES OF PREVENTING DEATH BY IMMEDIATE MEDICAL ATTENTION ARE VERY HIGH.
COMPULSORY INSURANCE: THE MOTOR VEHICLE ACCIDENT FUND WILL BE ESTABLISHED TO PROVIDE COMPULSORY INSURANCE FOR ALL ROAD USERS IN INDIA.
THE BILL ALSO ADDRESSES ISSUES SUCH AS TAXI OPERATOR REGULATION, FOREIGN COMPANY INSURANCE AND THE DEVELOPMENT OF A NATIONAL TRANSPORT POLICY AND IMPROVE SERVICES THROUGH DIGITALIZATION AND E-GOVERNANCE.
THE OWNER OF THE VEHICLE OR GUARDIAN WILL BE ARRESTED IN THE EVENT OF A TRAFFIC VIOLATION BY AADHAR BEING COMPELLED TO OBTAIN A DRIVER’S LICENSE AND VEHICLE REGISTRATION.
FINES AND OBLIGATIONS
RECKLESS DRIVING WILL COST A FINE OF RS. 5000 PREVIOUSLY WAS RS.1000.
DRIVING WITHOUT A DRIVER’S LICENSE WILL BE FINED RS 5000 INSTEAD OF THE PREVIOUS 500.
OFFENSE BY JUVENILES IS A NEW CATEGORY INTRODUCED. THE CHILD CAREGIVER / CAR OWNER WILL NOW BE FINED RS. 25,000 AND 3 YRS IN PRISON. FOR YOUTH TO BE PROSECUTED UNDER THE JUVENILES JUSTICE ACT. VEHICLE REGISTRATION WILL BE CANCELED.
IF THE CAR MANUFACTURER FAILS TO COMPLY WITH THE CAR’S STANDARDS, THE FINE WILL BE A FINE OF UP TO RS 100 CRORE, OR IMPRISONMENT FOR A PERIOD OF UP TO ONE YEAR, OR BOTH.
IF THE CONTRACTOR FAILS TO COMPLY WITH THE ROAD DESIGN STANDARDS, THE FINE WILL BE RS.1 LAC.
UNDER SECTION 196 OF THE MOTOR VEHICLE ACT, 2019 DRIVING WITHOUT INSURANCE WILL BE FINED RS 2000.
UNDER SECTION 194 D OF THE ACT; RIDES WITHOUT HELMET WILL BE FINED RS 1000 AND CANCELED 3 MONTHS FOR LICENSING.
UNDER SECTION 194B OF THE ACT; DRIVING WITHOUT A BELT WILL COST RS. 1000.
RUNNING / RACING WILL BE FINED RS 5,000 INSTEAD OF RS 500 IN ADVANCE.
UNDER SECTION 194 E OF THE ACT; NOT PROVIDING AN EMERGENCY VEHICLE WILL COST RS 10,000.
