Differences between Tort & Crime
In this article, we will be distinguishing between a Torts and a Crime according to the basis of differentiation such as sincerity, action initiated, damage, punishment and many more.
Definition:
Tort has been derived from the Latin term “tortum” which means to twist.
Crime is an act or illegal omission which causes harm to another person that is forbidden by law.

In tort, the action is initiated by the injured party. |
Action initiated | In crime, proceedings are conducted in the name of the state. |
In tort, wrongdoer has to reimbursed images to the injured party. |
Damages
| In crime, the offender is punished by the state, in the interest of society. |
Damage imposed to him goes to the injured party. |
| Fine imposed on the offender goes to the government treasury. |
Punishment is unliquidated damages. |
Punishment | Punishment is imprisonment and or fine. |
The intention is of subordinate importance in tort. |
Intention | In crime, intention is the main factor or the constituent element of the crime. |
The similarity between tort and crime is that both are “Right in Rem” which means right against the world at large.
