The first thing I would check if I would have to form an LLC in the US being an Indian would be the capacity to seek visa . Potential to seek visa and open an bank account for the LCC in the US would be the first priority and step . Who can form an LCC in the US

The second step consist of choosing a name for LCC there is some common guidelines that has been put forward there is no such rule while choosing a name for LLC but a very common an authoritative name should be avoided while choosing a name for LTC like one cannot use the words that would confuse the government of that Particular state as each state has different set of rules words like state SBI treasury cannot be used which is a very obvious and valid restriction but by the state also authoritative names such as attorney University cannot be used as it requires for the paperwork and can only be used by authoritative people or professional people

Also, the name which must be included is the LCC

After turn the determination of the name one must also check if the URL is available for the same which can be used in future if not in use presently

Filing of LCC


For the officiality and legality of LCC , documents containing the structure and details of the business needs to be filed with the state.



As all states have their own set of rules , LCC operating agreement is not required or say not given much light in many states but still it’s better to have one as it contains the operations , details and procedures of the LCC.


The Internal Revenue Service form needs to filled and submitted to obtain the EIN NO.

Foreigners cannot fill the form the online as it requires Other Identification no. So ,they can apply for the same by mail or fax

The EIN no. Is mandatory for every LCC for tax purposes 


The organisation must have a physical mailing

Address in the state of LCC if the organisation have physical office Then that can be used while opening a bank account in the state chosen and if by any chance the there is no physical office.
